A. Street improvements shall be classified as either developer funded and installed street improvements or as publicly funded and installed street improvements.

B. If street improvements have been constructed at the expense of a developer, adjacent property owners within the assessment reimbursement area shall not be allowed to have their developments approved until all fees required by the contract between the city and the developer have been collected, or until the contract expires. These development limitations shall be enforced for a period not to exceed fifteen (15) years from the date that City Council accepts the street improvements. If the Finance Director cannot locate the developer by registered or certified mail prior to fifteen (15) years after acceptance of street improvements, the limitation for development shall cease.
