A. Pursuant to provisions of the Revised Code of Washington, the Federal Communications Act of 1982 and 1996, and other lawful authority, the City has the authority to regulate the use of its streets and other City property.

B. The City Council finds that an increasing number of telecommunications carriers, open video system operators and cable operators have requested or may request access to and the use of rights-of-way and public property; and to the extent permitted by law, the City finds it is in the public interest to require the obtaining of business registration, licenses, franchises, cable franchises and leases from the persons or entities that use public property, easements and rights-of-way.

C. To ensure orderly and reasonable access to the rights-of-way and public property for telecommunications carriers and cable operators while protecting the public health, safety and welfare, the City Council determines that it needs to include regulations and standards for the use of such property.
