The Municipal Services Director may allow fences, walls, and hedges to be installed or planted in public places; provided that, the fences, walls, and hedges shall comply with the following conditions.

A. A fence permit is required in accordance with Title 18 (Zoning Ordinance) of the Moses Lake Municipal Code prior to construction of any fence.

B. The fence, wall, or hedge shall comply with all height regulations of the zoning ordinance.

C. The fence, wall, or hedge shall not cause a traffic hazard by obstructing views of traffic or pedestrian movements.

D. The city and the public utility companies may remove the fence, wall, or hedge for installation, repair, or replacement of municipal improvements and public utilities without being required to reconstruct the fence, wall, or hedge. However, the owner may have the fence, wall, or hedge reconstructed; provided, that the owner pays for all reconstruction costs.

E. The fence, wall, or hedge shall be constructed behind the municipal sidewalk if sidewalks are installed.

F. The fence, wall, or hedge shall be constructed at least six feet (6') behind the curb and shall provide for a minimum six feet (6') of clearance when sidewalks do not exist.

G. The fence, wall, or hedge shall be constructed to avoid placement over public utilities and municipal improvements.

H. The fence, wall, or hedge shall not block the view of signs that are installed behind the curb or sidewalk.

I. The Municipal Services Director shall have approved the installation and location of the fence, wall, or hedge prior to construction. (Ord. 2226, 8/9/05; Ord. 774, 1976)
