A. This chapter is created pursuant to RCW 46.55.120 and 46.55.240 as now enacted or hereafter amended.

B. Whenever the driver of a vehicle is arrested or cited for a violation of RCW 46.20.005, 46.20.015, 46.20.342, 46.20.420, 46.61.502, or 46.61.504, the vehicle is subject to impoundment at the direction of a police officer. The operation of a vehicle under circumstances leading the officer to arrest or cite the operator for any of the violations listed in this section is sufficient cause for the officer to cause the vehicle to be impounded as provided in this chapter.

C. Whenever the driver of a vehicle is arrested or cited for a violation of RCW 46.20.005, 46.20.015, 46.20.342, 46.20.420, 46.61.502, or 46.61.504, then the vehicle may be released as soon as all the requirements of Section 10.40.020(A) are satisfied.

D. The vehicle impounded shall only be released as provided in Section 10.40.020(B) if the vehicle is impounded because the driver is arrested or cited for a violation of:

1. RCW 46.20.342(1)(c) and the Washington Department of Licensing’s records show that the driver has been convicted one (1) time of a violation of RCW 46.20.342 or similar local ordinance within the past five (5) years, or

2. RCW 46.20.342(1)(c) and the Washington Department of Licensing’s records show that the driver has been convicted two (2) or more times of a violation of RCW 46.20.342 or similar local ordinance within the past five (5) years, or

3. A violation of RCW 46.20.342(1)(a) or (b) and the Washington Department of Licensing’s records show that the driver has not been convicted of a violation of RCW 46.20.342(1)(a) or (b) or similar local ordinance within the past five (5) years, or

4. A violation of RCW 46.20.342(1)(a) or (b) and the Washington Department of Licensing’s records show that the driver has been convicted of a violation of RCW 46.20.342(1)(a) or (b) or similar local ordinance two (2) or more times within the past five (5) years.
